1) Who we are & what this policy covers

HTHF is a business-purpose financing broker—not a lender. We connect businesses to third-party financing providers (e.g., direct lenders, factors, equipment financiers). This policy explains how we collect, use, share, and protect information when you visit our website, submit a form (including Jotform), email us, text us (if you opt in), or otherwise interact with us.

GLBA note: Because we help connect borrowers and lenders, we can be a “financial institution” under the FTC Safeguards Rule. When we handle nonpublic personal information (NPI) in connection with getting financing, those data are protected by GLBA. California’s privacy law (CPRA) generally does not apply to GLBA-covered data, but we still protect all data responsibly.

2) Scope & audience

Business/commercial use only (U.S.) — Our services and site are intended for adults acting for a business purpose in the United States.

Not legal/financial advice — Site content is informational; decisions are yours.

3) Information we collect

We collect information directly from you, automatically from your device, and from service providers or financing partners.

A. You provide:

Business info (legal name/DBA, EIN, address, NAICS/industry, revenue, time in business).

Owner/guarantor info (name, title, email, phone).

Financial docs (e.g., bank statements or connections; invoices/AR/AP; equipment quotes).

Application details (use of funds, existing financing, preferences).

Communications (emails, form messages, call notes).

Consent records (checkboxes, timestamps, IP address).

B. Automatic/device data (site/Forms):

Pages viewed, timestamps, referring links.

IP address, browser/OS, device type.

Cookies or similar tech (for site operations/analytics).

C. From partners/service providers (as needed):

Identity/KYB verification results.

Bank-connect or statement parsing results (if you use such a tool).

Offer/decision status from lender partners.

Email delivery/engagement metrics (opens/clicks).

We do not knowingly collect sensitive personal data beyond what is reasonably necessary to evaluate business-purpose financing or operate our services.

4) How we use information (business purposes)

Evaluate fit for financing options and match you with appropriate providers.

Operate and improve the site, forms, and workflows; detect/prevent fraud.

Communicate with you (application updates, requested info, service notices).

Comply with laws, contracts, underwriting and audit requirements.

Market similar services to you (email; SMS only if you opt in); you may opt out anytime.

5) Sharing information

We share information only as needed and for business purposes:

Financing providers (direct lenders, factors, equipment financiers) to review your application and, if approved, originate/fund.

Service providers/Processors who help us run the business (e.g., website hosting, form processing, secure file storage, analytics, email delivery).

Compliance & safety (law enforcement/government) when legally required or to protect rights, security, or prevent fraud.

Corporate transactions (merger, acquisition) where your info may transfer consistent with this policy.

“Sale”/“Sharing” for targeted ads (state privacy laws)

We do not sell or share personal information as those terms are defined under the California Privacy Rights Act (CPRA) (no cross-context behavioral advertising).

If this changes, we will update this policy and provide a “Do Not Sell or Share My Personal Information” mechanism.

6) Cookies & tracking

We use necessary cookies for site functionality and may use basic analytics (e.g., Squarespace Analytics). If we add additional analytics or ad pixels, we’ll update this policy and (where required) display a cookie banner with choices.

7) Email, SMS, and credit pulls (consents)

Email: By submitting your info, you consent to receive emails related to your inquiry. Marketing emails include an unsubscribe link.

SMS: We text you only if you separately opt in (prior express written consent). Reply STOP to end. Message/data rates may apply.

Credit reports: HTHF does not pull credit in the normal course; lenders may do so if you proceed with an offer. If we ever need to pull a report ourselves, we will obtain specific written authorization first.

8) Data security (Safeguards)

We maintain a written information security program (WISP) aligned to the FTC Safeguards Rule, including:

Access controls (least-privilege), 2-factor authentication, role permissions.

Encryption in transit and at rest where available through our providers.

Vendor due diligence and confidentiality obligations.

Security awareness and incident response procedures.

No system is 100% secure, but we take commercially reasonable steps to protect information.

9) Data retention

Leads/applications not funded: typically up to 24 months for follow-up/records unless law or contract requires longer.

Funded transactions/required records: generally 5 years (or longer if required by law, audit, or contract).

We delete or de-identify when retention is no longer necessary.

10) Your choices & rights

Marketing choices:

Unsubscribe from marketing emails via the link in the message.

If you opted into SMS, reply STOP to end messages.

Access/Deletion/Correction (state rights):

Depending on your state (e.g., CA/VA/CO/CT), you may request to know/access, delete, or correct your personal information, and to limit certain uses of sensitive data.

with subject line “Privacy Request” and tell us what you want to do.

We will verify your identity (e.g., matching certain details). You may use an authorized agent with proper written authorization.

We aim to respond within 45 days (or as your state requires).

We will not discriminate against you for exercising your rights.

GLBA-covered data (e.g., info used to obtain financing) may be exempt from some state rights; we will explain if an exemption applies.

Nevada: You may email us to opt out of any “sale” (we do not sell PI as defined under Nevada law).

“Do Not Sell/Share”: We currently do not sell/share PI; if that changes, we will add a link and honor requests promptly.

11) Children’s data

Our site is not directed to children under 13. We do not knowingly collect children’s information. If you believe a child provided data, contact us to delete it.

12) International users

We operate in the United States. If you access the site from outside the U.S., you understand your data will be processed in the U.S. and subject to U.S. laws.

13) Third-party sites & tools

We link to or embed third-party tools (e.g., form processors, e-signature, identity verification, secure bank-connect). Their practices are governed by their own privacy policies and terms. We do not control third-party sites.

14) Changes to this policy

We may update this policy from time to time. The “Last Updated” date shows when changes took effect. Material changes will be highlighted on the site.
