1) Acceptance of These Terms

By visiting our website, using our forms (including Jotform), or communicating with us, you agree to these Terms of Use (“Terms”). If you do not agree, do not use our site or services.

2) Who We Are (Broker-Not-Lender)

HTHF is a business-purpose financing broker, not a lender. We match businesses with third-party financing providers. Any credit decisions, pricing, terms, and funding are made exclusively by those providers.

3) Business-Purpose Only; No Legal/Financial Advice

Our services are for U.S. business or commercial purposes only. Nothing here is legal, tax, accounting, or investment advice. You are responsible for your own decisions and for consulting professional advisors as needed.

4) No Offer, Guarantees, or Endorsements

Content on our site is informational. It is not an offer or commitment to lend. We do not guarantee approvals, amounts, rates, speed, or outcomes. References to providers or products are not endorsements.

5) Your Responsibilities

You agree to:

Provide accurate, complete, and current information.

Use our site only for lawful business purposes.

Not submit information you lack the right to share.

Not interfere with site security or attempt to reverse engineer our site.

6) Eligibility

You represent that you (a) are at least 18, (b) are acting on behalf of a business, and (c) have authority to bind that business.

7) Service Area & State Rules

HTHF currently serves most U.S. states and may exclude certain states with extra rules. Availability can change. Some states require commercial financing disclosures by providers and/or brokers. Where such rules apply, we and/or our partners will provide required disclosures before you accept any offer.

8) Compensation Disclosure

HTHF may receive compensation from financing providers if you fund a transaction, and/or you may elect to pay a broker fee where permitted by law. We will make any required compensation disclosures in writing at the appropriate time.

9) Third-Party Services & Links

Our site may link to third-party websites, platforms, or tools (e.g., lenders, e-signature, analytics). We do not control them and are not responsible for their content, security, or practices. Your use of third-party services is governed by their terms and policies.

10) E-Sign & Communications Consent

By submitting our forms or clicking to proceed, you agree to do business electronically and receive communications from us and/or providers by email (and by SMS only if you separately opt in). You can opt out of marketing emails at any time using the unsubscribe link. Texts can be stopped by replying STOP. Transactional messages related to your application may still be sent.

11) Privacy

Your use of the site is also governed by our Privacy Policy (see the “Privacy Policy” page). That policy explains what we collect, how we use it, sharing, choices, and your rights.

12) Intellectual Property

All content on the site (logos, text, graphics, software, and arrangement) is owned by HTHF or its licensors and is protected by law. You receive a limited, revocable, non-transferable license to access and use the site for your internal business evaluation only.

13) Prohibited Conduct

You agree not to:

Use any robot, scraper, or automated means to access the site beyond normal indexing.

Upload malware or attempt to bypass security features.

Misrepresent identity or affiliation, or submit fraudulent information.

Use the site to violate law or the rights of others.

14) Disclaimer of Warranties

THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HTHF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HTHF AND ITS OWNERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED $100.

16) Indemnification

You agree to indemnify and hold harmless HTHF and its owners, managers, employees, and agents from and against all claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the site/services, (b) your information, or (c) your breach of these Terms or applicable law.

17) Changes; Termination

We may update these Terms at any time by posting a new “Last Updated” date. Your continued use after changes means you accept them. We may suspend or terminate access at any time for any reason.

18) Governing Law; Venue

These Terms are governed by the laws of the State of Ohio (without regard to conflicts of law). Exclusive venue lies in the state or federal courts located in Montgomery County, Ohio, and you consent to their jurisdiction.

19) Severability; Waiver; Assignment

If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, sale, or reorganization.

20) Entire Agreement; Contact

These Terms, together with the Privacy Policy and any disclosures provided during an application, are the entire agreement between you and HTHF regarding site use.
